1. Scope of Services

1.1 Enrollment Assistance and Guidance
We provide information and assistance related to ACA/Obamacare marketplace health insurance plans in Florida, including plan comparison support, general subsidy and premium tax credit guidance, and help during enrollment. We may also discuss dental and vision options as supplemental coverage.

1.2 No Government Affiliation
We do not claim any government endorsement or affiliation. Only healthcare.gov is the official federal marketplace platform.

1.3 No Medical or Legal Advice
Content provided through the Services is for informational purposes only and does not constitute medical advice, diagnosis, treatment, legal advice, or tax preparation services. You should consult qualified professionals (e.g., a physician, attorney, or tax preparer) for specific advice.

1.4 Tax Guidance Clarification
Any tax-related information we provide is limited to general implications of health insurance on taxes. It is not tax preparation or filing. You must consult a qualified tax professional for personalized tax advice.

1.5 Geographic Limitation
We assist Florida residents only. If you are outside Florida, our Services may not be appropriate or available to you.

2. Eligibility and Use

2.1 Age and Capacity
You must be at least 18 years old and capable of entering into a binding agreement to use the Services.

2.2 Accurate Information
You agree to provide true, accurate, current, and complete information when interacting with our forms, scheduling consultations, or communicating with our agents.

2.3 Acceptable Use
You agree not to:

• Misuse, interfere with, or disrupt the Services;
• Attempt to gain unauthorized access to any part of the Services or related systems;
• Use the Services for fraudulent, deceptive, or unlawful purposes;

3. No Guarantees or Endorsements

We do not guarantee coverage approval, eligibility for subsidies, specific savings, or specific plan outcomes. Eligibility is determined by the marketplace and insurance carriers.

3.2 Plan Availability and Pricing
Plan availability, features, and pricing are set by carriers and the marketplace and may change at any time. We do not guarantee “lowest prices” or specific plan terms.

4. Compensation Disclosure

We may receive compensation from insurance companies for enrollments in plans you select with our assistance. This compensation does not increase the cost of your coverage. Plans cost the same whether you enroll directly or with our assistance.

5. Privacy and Data Security

5.1 Privacy Policy
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, disclose, and protect information. Please review it carefully. The Privacy Policy is incorporated into these Terms by reference.

5.2 Data You Provide
Do not submit sensitive medical information, Social Security Numbers, or other highly sensitive data through our landing page forms. If such data is required, we will provide secure methods.

5.3 Analytics, Tracking, and Remarketing
We may use analytics, conversion tracking, and remarketing in accordance with our Privacy Policy and applicable law.

8.3 Accessibility and Compatibility

9. Limitation of Liability

To the maximum extent permitted by law, in no event will Quality Insurance Services Agency, Inc., Enroll Health Now, our affiliates (including Quality Tax Plus Services, Inc.), directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits or revenue; loss of data; or other intangible losses arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages.

Our total liability for any claims arising out of or relating to the Services shall not exceed one hundred dollars (USD $100) or the amount you paid (if any) to use the Services in the 12 months preceding the event giving rise to the claim, whichever is greater. Some jurisdictions do not allow certain limitations; some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless Quality Insurance Services Agency, Inc., Enroll Health Now, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• your use of the Services;
• your violation of these Terms;
• your violation of any rights of a third party; or
• any information you submit through the Services.

11. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time without notice. We may also update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including if we believe you have violated these Terms. Upon termination, the license granted to you under these Terms will automatically end.

13. Governing Law and Dispute Resolution

These Terms and your use of the Services are governed by the laws of the State of Florida and applicable federal laws, without regard to conflict of law principles.

13.2 Venue
You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of such courts.

13.3 Jury Trial Waiver and Class Action Waiver
To the extent permitted by law, you and we waive any right to a jury trial. You and we also agree that any claims shall be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

By using the Services, submitting forms, or contacting us, you consent to receive communications from us electronically (including emails, texts where permitted, and calls) related to your inquiry, consultation, enrollment assistance, and related services. You can opt out of marketing communications at any time as described in our Privacy Policy.

15. Accessibility and Non-Discrimination

We strive to maintain our Services in alignment with WCAG 2.1 AA guidelines and do not discriminate based on race, color, national origin, disability, age, sex, gender identity, sexual orientation, or health status. If you encounter accessibility barriers, please contact us and we will assist you.

16. Entire Agreement; Severability; Waiver

These Terms, together with our Privacy Policy and any additional disclosures presented through the Services, constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, that provision will be modified to the minimum extent necessary to be enforceable, and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of such right or provision.
